Welcome to the FNOTrader.com's Terms of Use agreement. For purposes of this agreement, "Site" refers to the Company's website, which can be accessed at www.fnotrader.com and other domains under www.fnotrader.com. "Service" refers to the Company's services accessed via the Site or App, in which users can view data analytics about specific Stock Markets in India.
Privacy Policy
The Company respects the privacy of its Service users. Please refer to the Company's Privacy Policy which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement to the Privacy Policy as well as these Terms of Use.
About the Service
The Service allows you to view data analytics about Stock Markets in India, particularly NSE Futures and Options.
Registration Rules for User Conduct and Use of the Service
You need to be at least 13 years old to register for and use the Service. If you are a user who signs up for the Service, you will create a personalised account which includes a unique username and a password to access the Service and to receive messages from the Company. You agree to notify us immediately of any unauthorised use of your password and/or account. The Company will not be responsible for any liabilities, losses, or damages arising out of the unauthorised use of your member name, password and/or account.
Use Restrictions
Your permission to use the Site is conditioned upon the following use, posting and conduct restrictions:
You agree that you will not under any circumstances:
- Access the Service for any reason other than your personal, non-commercial use solely as permitted by the normal functionality of the Service
- Collect or harvest any personal data of any user of the Site or the Service
- Use the Site or the Service for the solicitation of business in the course of trade or in connection with a commercial enterprise
- Distribute any part or parts of the Site or the Service without our explicit written permission
- Use the Service for any unlawful purpose or for the promotion of illegal activities
- Attempt to, or harass, abuse or harm another person or group
- Use another user's account without permission
- Intentionally allow another user to access your account
- Provide false or inaccurate information when registering an account
- Interfere or attempt to interfere with the proper functioning of the Service
- Make any automated use of the Site, the Service or the related systems, or take any action that we deem to impose or to potentially impose an unreasonable or disproportionately large load on our servers or network infrastructure
- Bypass any robot exclusion headers or other measures we take to restrict access to the Service, or use any software, technology, or device to scrape, spider, or crawl the Service or harvest or manipulate data
- Circumvent, disable or otherwise interfere with any security-related features of the Service or features that prevent or restrict use or copying of content, or enforce limitations on use of the Service or the content accessible via the Service
- Publish or link to malicious content of any sort, including that intended to damage or disrupt another user's browser or computer.
Terms to create a user account
User creation
- You must provide a valid email address & mobile number to complete the sign-up process.
- You are responsible for maintaining the privacy and security of your account. We will not be held liable for any damage or loss that may result from your failure to protect your login information, including your password.
- We may communicate with you via e-mail / SMS / WhatsApp / other communication modes regarding your account, system updates, or other issues related to your account / use of the Service.
Payment & Access
Free Version
We allow the users to enjoy certain complimentary sections of the App. This Free Version is for the sole purpose of enabling you to use, enjoy & evaluate the benefit of the www.fnotrader.com website, in the manner permitted by these terms and conditions mentioned hereunder.
Paid Version
In order to use Paid Version, a prospective customer is required to obtain a periodic (monthly / quarterly / annual), personal, non-assignable, non-refundable and non-exclusive subscription to use the website www.fnotrader.com. There will be no refunds or credits for partial months of service, or refunds made should you not use the Service during a period of time when your account is open. No exceptions will be made.
Subscriptions using Payment Gateways
We have different purchase options available through payment Gateways like RazorPay, etc. Some of these plans are auto-renewal subscriptions. For subscription plans, the plan automatically renews at the end of each expiry period unless auto-renew is cancelled by the user. The Subscription may be managed by the user and auto-renewal may be cancelled from My Plans section at any time. On cancellation, the auto-renewal is stopped but current plans remain active till the end of the current expiry period. No Refunds are admissible for the remaining period of the current period on cancellation. Any discount coupons applied on a subscription payment will be applicable only for the first period and subsequent charges from next period onwards will apply at the full price unless otherwise stated explicitly. Customers under Subscription Payment Option will be charged the Subscription fee for the periodic renewal. Such subscription amounts might be modified on the product website from time to time without prior notice.
Trade via Brokers API
We provide our registered users with the ability to connect to various brokers through their trading APIs or gateways, enabling them to execute BUY and SELL transactions in NSE Futures and Options directly through their respective broking platforms.
www.fnotrader.com is not a trading terminal — the execution of the trade happens on the broker's platform. In this context, it is considered Algorithmic trading; though the users are placing the trades through www.fnotrader.com, they are sent to the exchange through the Broker's API.
This is an add-on facility that we provide to ease your process of putting an order with your broker. The company will not be responsible in any manner whatsoever for the losses, profits, revenues, financial losses, lack of connectivity or indirect, special, consequential, exemplary, or punitive damages while using the Trade facility in the Application. The company will not be held liable for any expense, loss or damage whatsoever.
Risks of engaging in trading through Trading APIs provided by Stock Brokers — www.fnotrader.com allows you to engage in live trading using the broker's API access given to you by the broker. Engaging in live trading subjects you to:
- The risks associated with trading generally.
- The risks associated with live trading using brokers' trading APIs through www.fnotrader.com.
- Your broker may experience failures in its infrastructure, fail to execute your orders in a correct or timely fashion or reject your orders.
- FNOTrader's infrastructure (on which you trigger trades) might fail. Even if FNOTrader's and your broker's infrastructure are working correctly, the orders may get rejected or triggered in error or by design, incorrectly executed, or induce errors through unexpected behaviour (returning messages out of sequence, incorrectly acknowledging orders, or posting incorrect execution reports). The company bears no responsibility for any losses arising from these risks.
- The system you use for generating orders, communicating those orders to your broker, and receiving queries and trading results from your broker may fail or not function in a correct or timely manner.
- Latency (delays) within and between your system, FNOTrader servers, the broker and the exchanges might cause orders, modifications, and cancels to be placed or not placed in ways that are not desired. You may receive incorrect information, or be unable to get information, about your orders, your positions, or market conditions.
- Time lag at various points in live trading might cause unexpected behaviour. The time lag between placing an order in www.fnotrader.com and the order placed in the system can cause a delayed order placement in the market, lead to cancellations, and cause you loss (or fail to gain profits).
- The systems of third parties — including data providers, your broker, and the applicable securities market — may fail or malfunction.
- Accurate and complete real-time price data is critical for the success of trading and depends on the Broker's API. The broker's API could experience failures, errors, and latency, which could result in missing, incorrect, or stale market data.
- Malicious and criminal activities might cause your strategy or strategies to fail, or your brokerage account to be compromised. All computers and networks are subject to malicious "hacking" attacks and criminal activities designed to misappropriate intellectual property, compromise personally identifiable information, steal funds, or any combination of such purposes.
Fraudulent Activity
We strongly discourage you from availing any service, including promotional offers and discounts, from individuals or entities that may be pretending or masquerading as Company's representative / partner / affiliate ("actors") in any manner, as this is not endorsed or permitted by the company and you run the risk of fraud by indulging in the same. We are not responsible for any activity or transactions that you undertake with such fraudulent actors and we are not liable for any charges / payments that you might have paid to them.
Links to Other Sites and Materials
As part of the Service, we may provide you with convenient links to third party website(s) ("Third Party Sites") as well as content or items belonging to or originating from third parties ("Third Party Applications, Software or Content"). These links are provided as a courtesy to Service subscribers. We have no control over Third Party Sites or Third Party Applications, Software or Content or the promotions, materials, information, goods or services available on these Third Party Sites. Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site. Inclusion of, linking to or permitting the use or installation of any Third Party Site does not imply our approval or endorsement. If you decide to leave the Site and access a Third Party Site or to use or install any Third Party Application, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any Third Party Site to which you navigate.
Intellectual Property
You acknowledge and agree that we retain ownership of all intellectual property rights of any kind related to the Service, including applicable copyrights, trademarks and other proprietary rights. Other product and company names that are mentioned on the Service may be trademarks of their respective owners. We reserve all rights that are not expressly granted to you under these Terms of Use.
User consent to receive communications in electronic form
For contractual purposes, you: (a) consent to receive communications from us in an electronic form via SMS, email, WhatsApp, Telegram; and (b) agree that all Terms of Use, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights. We may also use your email address to send you other messages, including information about the Site or the Service and special offers. You may opt out of such email by changing your account settings, using the "Unsubscribe" link in the message, or by sending an email to support@fnotrader.com. Opting out may prevent you from receiving messages regarding the Site, the Service or special offers.
General Terms
Your use of the service, including any content, information or functionality contained within it, is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of our Services.
The company makes no warranties regarding (i) your ability to use our Services, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free, (iv) the accuracy of data provided by the Service, and (v) that bugs or errors in the Service will be corrected.
The company, its partners, agents, affiliates and its sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of our Services, irrespective of whether you are a user of the Free Version or Paid Version. Your sole remedy for dissatisfaction with our Services is to STOP using it.
Failure of the company to exercise any of its rights provided herein shall not be deemed to be a waiver of any such right unless such waiver has been expressly given in writing. This latest version of Terms of Use sets forth the entire understanding between you and the company.
The company cannot be held responsible for any business loss of a customer for any reason whatsoever including software failure / delay in implementation or in technical support, etc.
We may assign or delegate these Terms of Service and/or our Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without our prior written consent, and any unauthorised assignment or delegation by you is void.
You acknowledge that you have read these terms of use, understand the terms of use, and will be bound by these terms and conditions. You further acknowledge that these terms of use together with the privacy policy represent the complete and exclusive statement of the agreement between us and that it supersedes any proposal or prior agreement, oral or written, and any other communications between us relating to the subject matter of this agreement.
Governing Law
These terms of use shall be governed by and construed in accordance with Indian law without reference to its conflicts of law principles. You hereby expressly agree to submit to the exclusive personal jurisdiction of India and state courts of the State of Telangana for the purpose of resolving any dispute relating to your access to or use of our product and/or services. This clause shall survive termination of this Agreement.
